Acceptance of Terms of Use:
The following Terms of Use apply to anyone accessing and using the BT Tradespace (Site), or any part of it. BT may modify these Terms of Use from time to time and accordingly you are advised to keep up to date with the changes by regularly reviewing the Terms. By using the Site you agree to be bound by these Terms. You should note that individual Tradespace sites forming part of the Site may have additional terms and conditions that apply to them.
Eligibility:
BT Tradespace is available to you for your personal use which may include business networking, creation and support of your customers and legitimate commercial activities as provided by the Site. We do not permit use of the Site for your direct commercial gain, for example selling access to a community.
Members should be sixteen years of age or older. Any registration by anyone under 16 is not permitted.
Access, Account Security and Registration Data:
When you use BT Tradespace, you may set up a personal profile, contact other users, join or set-up a community, set up events and perform searches or queries, rate or review businesses and comment on BT Tradespace members’ blogs.
It is your responsibility to ensure that you have an appropriate web browser or any other technical requirements in place in order to access and make use of the Site.
In using this Site, you agree to
- provide us with and maintain accurate, current and complete information about you on registration to the Site;
- maintain and promptly update any information you provide to us including registration information, where it may have changed, keeping it accurate, current and complete; and
- be fully responsible for all use of your account and for any actions that take place using your account.
Security:
You are responsible for the security and proper use of any user IDs, PIN numbers and passwords required for registration on the Site and to maintain your BT Tradespace member site, and must take all necessary steps to ensure that they are kept confidential, secure, used properly and not disclosed to unauthorised people.
Although we provide security measures to prevent access by unauthorised users to BT Tradespace member sites, we do not guarantee that such security measures are fault free. You acknowledge that your BT Tradespace members site could be accessed by unauthorised users should they be able to break through or bypass our security measures.
Changes to the Site:
BT reserves the right to modify, edit, delete, suspend or discontinue, temporarily or permanently, the Site (or any part of it) and/or the information, content, videos, materials, products and/or services (or any part of them) available through the Site at any time.
Ownership of Content that we provide:
The content of the Site is protected by copyright, trademark and other intellectual property rights as applicable.
Except for your content that you have the legitimate right to post or make available on the Site, all content on the Site is owned by us or licensed to us by third parties, including information, text, designs, graphics, pictures, video, photographs, applications, software, audio and other files, and their selection and presentation (”Our Content").
You must not, without our prior written consent, copy, publish, download, de-compile or modify Our Content or use any or part of the content, without our written permission. You may download or print a copy of any part of Our Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright, trademarks, logos or other proprietary notices intact. We may withdraw this consent at any time for any reason.
Content you post on the Site:
You are responsible for all content, including information, text, pictures, photographs, messages, notes, videos software, and other files or material, that you upload or post on the Site or communicate to other users through the Site. If you did not create content that you post or otherwise make available to the Site, it is your responsibility to ensure that you have the necessary consent from the owner of the content to use it on the Site. You are responsible at your own cost for creating backup copies and replacing any content that you upload or post on the Site or provide to us.
When you upload, post or otherwise make available your content to the Site you automatically grant us at no additional charge permission to use any or all of your content for any purpose (including for editorial reasons) anywhere in the world, including where we may share your content with third party websites. This permission is not exclusive.
You agree to indemnify us against all claims and proceedings arising from infringement of any third person's intellectual property rights as a result of content that you have posted no or made available on the Site. This indemnity does not apply to claims or proceedings arising from our use of your content other than in accordance with these Terms of Use. We can withdraw your content at anytime without notice for any reason.
Trademarks:
BT Tradespace™ is a trademark of British Telecommunications plc. All other trademarks, product names and company names or logos cited anywhere on “BTTradespace.com” are the property of their respective owners.
User Conduct:
You agree not to use the Site to:
- act in any way that is unlawful or defamatory, in contravention of any licence, third party rights, or i any guidance that we may give to you , and you will comply with our Acceptable Use Policy. This is located at www.abuse-guidance.com and may be amended from time to time;
- damage, disable, overload or affect the operation of the Site;
- collect email addresses or other contact information of other users from the Site by any means for the purposes of sending unsolicited emails or other unsolicited communications;
- solicit personal information, passwords or other personally identifying information for commercial or unlawful purposes;
- register yourself for more than one account, or register on behalf of another individual or group without our written consent;
- provide false or misleading information about yourself or your business, or create a false identity;
- use or attempt to use another's account, service or system without our written authorisation,
BT takes the misuse described above very seriously, and you agree to take all reasonable steps to make sure that it does not happen.
If BT reasonably believes that it has happened, BT may take immediate action to remove your content or suspend or end your access to the Site without telling you first, even if you were not aware of the misuse.
You agree to indemnify BT against all legal fees, damages and other expenses that BT may reasonably incur as a result of your breach of the paragraphs above.
If you believe that any content displayed or made available on the Site includes any of the above offences, you may contact us through the Site.
Personal Data:
In addition to our commitments under our Privacy Policy, BT may keep any personal data that you disclose for the purposes of general trend and market analysis.
It is your responsibility to ensure that you have the necessary consents if you pass on a third party’s e mail address to BT.
Liability:
BT will be liable if you are injured or die as a result of our negligence. We do not limit that liability by these Terms any other way.
We have no liability in contract , tort ( including negligence) or otherwise) for any loss not reasonably foreseeable by us nor for any loss of opportunity, goodwill, reputation, business, revenue, profit, or savings you expected to make, wasted expenditure or data being lost or corrupted.
Any liability we have of any sort (including liability for negligence) is limited to £100 for all events in any 12 month period.
The Site is provided by us on an "as is" basis and when available. BT excludes any and all warranties or representations, whether express or implied, to the fullest extent permitted by law, concerning the availability and accuracy of the Site.
BT excludes all liability of any kind (including negligence) in respect of any third party product, services, content, or other material made available on, or which can be accessed using, the Site or the validity of the provider of such product, services, content or other materials.
This does not in any way affect your statutory rights.
Disclaimer of warranties and representations:
BT excludes any and all warranties or representations whether express or implied, including without limitation any warranties or representations for merchantability, suitability, fitness for a particular purpose, non-infringement of proprietary rights or the accuracy or completeness of third party products, services, content or any other material made available on, or which can be accessed using, the Site, to the fullest extent permitted by law, (excluding fraudulent representations made by BT).
BT recommends that independent advice is sought regarding the accuracy or completeness of the products, services and content referred to or made available on this Site.
User Disputes:
You are solely responsible for your interactions with other BT Tradespace users. We reserve the right, but have no obligation, to monitor disputes between you and other users.
Law:
These Terms of Use are governed by and will be interpreted in accordance with English Law and any disputes relating to these terms will be subject to the exclusive jurisdiction of the English courts.
If any jurisdiction does not allow the exclusion of certain warranties or exclusion or limitation of liability for consequential or incidental damages, liability is limited to the fullest extent permitted by law and the remaining terms shall survive in full force and effect.
